1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Leandro Barreto ("Developer," "we," "us," or "our") regarding your use of the Creator Companion mobile application and Miro integration ("App" or "Creator Companion").

By accessing or using Creator Companion, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, please do not download, install, or use the App.

2. Description of Service

Creator Companion is a productivity application designed to help content creators:

• Capture and organize creative ideas quickly
• Categorize ideas with labels (Idea, Concept, Product, Script, Thumbnail, Collab, Trending, Series)
• Set priority levels and track progress status
• Specify content type (short-form or long-form)
• Select target social media platforms (YouTube, Instagram, TikTok, Facebook, Other)
• Share ideas to Miro boards for visual collaboration
• Sync data across devices via user accounts

3. User Accounts

To access certain features of Creator Companion, you must create an account. When creating an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these Terms or for any other reason at our sole discretion.

4. User Content

You retain ownership of all ideas, notes, and content you create within Creator Companion ("User Content"). By using the App, you grant us a limited license to:

• Store your User Content on our servers to provide the service
• Display your User Content back to you within the App
• Create backups to prevent data loss

5. Acceptable Use

You agree to:

• Use the App only for its intended purpose of idea capture and organization
• Comply with all applicable laws and regulations
• Respect the intellectual property rights of others
• Keep your account credentials secure

You agree NOT to:

• Use the App for any unlawful purpose
• Attempt to reverse engineer, decompile, or disassemble the App
• Redistribute, sublicense, or sell the App
• Interfere with or disrupt the App's servers or networks
• Attempt to gain unauthorized access to other users' accounts
• Use the App to store or transmit malicious content
• Create multiple accounts for abusive purposes

6. Third-Party Integrations

Miro Integration

Creator Companion offers integration with Miro. When using this feature:

• You must have a valid Miro account and access token
• Your use of Miro is subject to Miro's own Terms of Service
• We are not responsible for any issues arising from Miro's service
• Data shared with Miro is subject to Miro's privacy practices

Social Media Platform References

The App allows you to tag ideas with social media platform names (YouTube, Instagram, TikTok, Facebook). This is for organizational purposes only. We have no affiliation with these platforms, and their names and trademarks are property of their respective owners.

7. Data and Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we handle your information.

• Local data is stored securely on your device using SwiftData
• Account data is stored securely on our servers
• We use industry-standard security practices
• We do not sell your personal information

8. In-App Purchases and Subscriptions

Auto-Renewable Subscriptions

Creator Companion offers an optional auto-renewable subscription:

• Creator Companion Pro Monthly: $9.99 USD per month

Subscription terms:

• Payment will be charged to your Apple ID account at confirmation of purchase
• The subscription automatically renews unless auto-renewal is turned off at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel your subscriptions by going to your Account Settings in the App Store after purchase

Credit Packs

Creator Companion offers consumable AI credit packs for use with AI-powered features:

• 50 Credits: $0.99 USD
• 150 Credits (+10 Bonus): $2.99 USD
• 400 Credits (+50 Bonus): $6.99 USD
• 1000 Credits (+200 Bonus): $14.99 USD

Credits are consumable and non-refundable once used. Unused credits remain in your account.

General Purchase Terms

All purchases and subscriptions are processed by Apple through the App Store. The Developer does not process payments directly. Refund requests must be directed to Apple in accordance with their refund policies. Prices are in USD and may vary in other regions based on Apple's currency conversion.

9. Intellectual Property

The App and its original content, features, and functionality are owned by Leandro Barreto and are protected by international copyright, trademark, and other intellectual property laws.

• The Creator Companion name, logo, and branding are property of the Developer
• You may not copy, modify, or distribute the App's source code without permission
• User Content remains your intellectual property

10. Disclaimer of Warranties

The App is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to:

• Implied warranties of merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy, reliability, or completeness of any information

We do not warrant that:

• The App will be uninterrupted, timely, secure, or error-free
• The results obtained from using the App will meet your expectations
• Any errors in the App will be corrected
• Your ideas will become successful content

11. Limitation of Liability

To the fullest extent permitted by applicable law, the Developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of data or ideas
• Loss of profits or revenue
• Business interruption
• Any damages arising from your use or inability to use the App

This limitation applies regardless of the legal theory under which damages are sought.

12. Indemnification

You agree to defend, indemnify, and hold harmless the Developer from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Your User Content

13. App Store Terms

Your use of the App is also subject to Apple's App Store Terms of Service. In case of any conflict between these Terms and the App Store Terms, the App Store Terms shall prevail to the extent of the conflict.

You acknowledge that:

• These Terms are between you and the Developer, not Apple
• Apple has no obligation to provide maintenance or support for the App
• Apple is not responsible for any claims related to the App

14. Updates and Modifications

We reserve the right to:

• Modify, suspend, or discontinue the App at any time without notice
• Update these Terms at any time
• Release updates to the App that may add, modify, or remove features
• Change pricing for premium features (if applicable)

Continued use of the App after any changes to these Terms constitutes your acceptance of the revised Terms.

15. Termination

You may terminate this agreement at any time by:

• Deleting the App from your device
• Requesting account deletion by contacting us

Upon termination:

• Local data stored on your device will be permanently deleted
• Account data may be retained for a reasonable period for legal compliance
• Your license to use the App will be revoked
• Sections regarding disclaimers, limitations of liability, and indemnification shall survive termination

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the Developer resides, without regard to its conflict of law provisions.

17. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and the Developer regarding the use of the App and supersede any prior agreements.
